These Terms & Conditions (“Terms”) govern your use of all services, websites, communication channels (including phone,SMS, or email), and any related interactions with BWJ Property Management LLC (“BWJ,” “we,” “our,” or “us”). By engaging with our services, submitting an application, or using our site, you accept and agree to be bound by these Terms

If you do not agree to these Terms in full, you are not authorized to access or use our services.

1. Services Provided

BWJ Property Management LLC provides services related to:

  • Real estate investment and property management.

  • Private money lending and loan servicing.

  • Review and processing of borrower applications and creditworthiness .

  • Structuring and funding of short-term or long-term real estate loans.

  • Issuance of loan documents, servicing agreements, and payment tracking

All lending activities are subject to underwriting criteria, documentation, and regulatory compliance. We do not make guarantees of loan approval, funding timelines, investment returns, or property performance.

2. Use of Proprietary Materials

All contracts, templates, disclosures, loan documents, underwriting frameworks, and internal processes provided by BWJ Property Management LLC remain our sole intellectual property. You may not copy, reproduce, redistribute, or use any part of these materials outside the scope of the transaction for which they were provided, unless expressly authorized in writing

3. Payments & Fees

  • all payments, fees, or investment contributions must be made as instructed in the written agreement or invoice associated with your transaction.Private money lending and loan servicing.

  • Loan servicing fees, origination fees, or broker fees (if applicable) will be disclosed in writing prior to the disbursement or funding.

  • Failure to make timely payments may result in late fees, default status, legal collection actions, or other consequences per the loan agreement.

  • All payments are final unless otherwise agreed in writing under the specific terms of a

    refund, cancellation, or rescission clause outlined in your signed agreement.

4. Termination & Cancellation

  • Clients may withdraw from a pending transaction or service by providing written notice before final funding or execution of contracts.

  • BWJ Property Management LLC reserves the right to cancel or terminate services at any time for:

  • Fraudulent misrepresentation

  • Non-payment or breach of agreement

  • Regulatory or legal risk

  • Failure to provide necessary documentation or access

  • Termination does not entitle a party to reimbursement unless expressly stated in a governing agreement.

5. Limitation of Liability

To the fullest extent permitted by law, BWJ Property Management LLC shall not be liable for any:

  • Losses arising from investment or lending risk.

  • Property-related issues including vacancy, damage, or tenant default.

  • Delays in funding caused by third-party verifications, title issues, or borrower inaction.

  • Incidental, consequential, or indirect damages arising from your use of our services or reliance on our representations.

You acknowledge that all lending and investing activities carry risk and agree to assume full responsibility for any losses resulting from such activities

6. Dispute Resolution

All disputes, claims, or controversies arising out of or relating to our services, agreements, or communications shall be resolved by binding arbitration in the State of Wyoming, pursuant to the rules of the American Arbitration Association (AAA). You waive any right to a jury trial and agree to resolve disputes exclusively through arbitration. These Terms are governed by the laws of the United States and the State of Wyoming.

7. User Obligations

By engaging with BWJ Property Management LLC, you agree to:

  • Provide complete, truthful, and accurate information.

  • Submit all required documentation (e.g., ID, proof of income, insurance, title documents) in a timely manner.

  • Honor all agreements, deadlines, and payment terms.

  • Cooperate fully during underwriting, funding, and servicing processes.

Failure to comply may result in termination, loss of service, or legal enforcement under applicable law.

8. Third-Party Tools & Partners

BWJ Property Management LLC may utilize third-party platforms for communication, document signing, payment processing, or reporting (e.g., Stripe, DocuSign, Google Drive, banking institutions). We do not control these platforms and are not responsible for their outages, data issues, or policies. Your use of these tools is subject to their respective terms of service.

9. Amendments

BWJ Property Management LLC may amend these Terms at any time, and such amendments will take effect immediately upon publication at our designated business address or website. All revised versions supersede prior agreements unless a separate written contract states otherwise.
